You can use an independent Parent Evaluation when filing a motion for physical custody. It supports the claim that the parent has either already been a successful primary caregiver and or is capable of providing such care. Parent Evaluations are based on a functional assessment of parent competence, based on scientific research and a table of authorities. Evaluations include a school support plan which can effectively prevent or stop a geographic relocation of a child. This puts the education of the child under the parent’s authority in a custody decision. School support plans may hold due process of law authority. Family Courts are required to recognize these formal school support plans and adhere to no exclusion of either parent.
